Dispute Resolution

Binding Arbitration: If informal resolution fails, any dispute arising from these Terms or the Services shall be resolved through binding arbitration conducted in Charlotte, NC, administered by the American Arbitration Association under its AAA Consumer Arbitration Rules. The Company will pay all arbitration filing and administration fees beyond the initial consumer filing fee.

Small Claims Exception: Either party may bring an individual action in small claims court in Mecklenburg County, NC, if the claim qualifies.

Class Action Waiver: To the maximum extent permitted by applicable law, all claims must be brought in an individual capacity and not as a class member in any purported class, consolidated, or representative proceeding.

Opt-Out: You may opt out of this arbitration provision by sending written notice to support@ideaforgestudios.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Mecklenburg County, North Carolina.

Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or related to these Terms or the Services shall not exceed the total fees paid by you during the 12 months of fees paid preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages. If any part of this limitation is found unenforceable, the remaining limitations shall continue to apply.

Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles.

General Provisions
